These Terms of Service ("Terms") govern your access to and use of TrackOfferz (the "Service") operated by TrackOfferz Inc. ("we", "us"). By creating an account or using the Service, you agree to be bound by these Terms.
1. Account
You must be at least 18 years old and have the authority to bind your organization. You're responsible for maintaining the security of your account credentials. Notify us promptly of any unauthorized access.
2. Acceptable use
You agree not to use the Service to: (a) track campaigns that promote illegal goods or services; (b) violate applicable advertising regulations (including, where applicable, gambling, financial services, healthcare); (c) send unsolicited communication; (d) reverse-engineer or stress-test the platform without prior written authorization; (e) attempt to defeat or bypass rate limits, fraud filters, or tenant isolation.
3. Subscription + billing
The Service is billed monthly or annually based on the plan you select. Subscriptions auto-renew at the end of each billing period unless canceled. You can cancel at any time from your account settings; cancellation takes effect at the end of the current billing period.
4. Free trial
New organizations get a 14-day free trial with no payment method required. If you do not subscribe by the trial's end, your account moves to read-only and is suspended for new tracking activity.
5. Refunds
Monthly subscription fees are non-refundable. Annual subscriptions canceled within the first 30 days are eligible for a pro-rated refund. Contact billing@trackofferz.com.
6. Data ownership
You own all data you submit to the Service. We obtain a limited license to process that data solely to operate the Service on your behalf. We do not sell or share your data with third parties except as described in our Privacy Policy.
7. Service level
We target 99.9% monthly uptime for the tracking edge. Scheduled maintenance is announced 48 hours in advance and excluded from uptime calculations. Specific SLAs are available on the Enterprise PLUS plan.
8. Limitation of liability
To the maximum extent permitted by law, our aggregate liability under these Terms is limited to the amount you paid us in the 12 months preceding the claim. We are not liable for indirect, consequential, or incidental damages.
9. Termination
We may suspend or terminate your account if you violate these Terms or if your account is found to be supporting fraudulent activity. You may export your data within 30 days of termination.
10. Governing law
These Terms are governed by the laws of Delaware, USA. Any disputes will be resolved in the state and federal courts located in Delaware.
11. Changes
We may revise these Terms periodically. We'll notify you of material changes by email at least 30 days in advance.
